Terms and Conditions of Sale
Your use of Products and Services we offer shall be on personal, non-exclusive and non-transferable basis. If these Terms and Conditions of Sale are inconsistent with any other “legal notice”, that “legal notice” or applicable provisions of that “legal notice” will preside.
You shall pay for your order by using a payment method listed at the Checkout page. If you select cash on delivery payment method when placing an order; you shall pay for your order with cash immediately on delivery of your order and before opening the parcel. If you select to pay to our bank account, you must provide your user details (name) and Order number as references when making the payment and your order will be processed only when we acknowledge receipt of the full payment for the order.
At our discretion we may offer you following options to discount and/or settle part or full amount of your order. If we have offered you more than one option, you may choose more than one option to discount your order. After choosing any of the options to discount your order, if there is still balance remaining to be paid you shall use a payment method listed at the checkout page to settle balance payment of your order. These options cannot be used to discount previous orders and/or orders in process. Certain Products and Services may not be eligible to be discounted by these options. Each Option may be valid for a limited time period. The validity period and any other specific requirements are made at our sole discretion and may be changed, suspended or revoked at any time without any prior notice to you. None of offers made in any of the options has no cash value.
Discount Code: If we have offered you a Discount Code then you can discount your order.
Gift Card Code Value: You can use your Gift Card Code Value to pay for your order. The Gift Card Code value you used will be deducted from your Gift Card Value balance when you place an order. The used Gift card Value will not be refunded if you cancel or return your order.
Rewards Points: If we have provided Rewards Points to your account, you can use these Rewards Points to discount part or full value of your order. Used Rewards Points will be deducted from Rewards points balance when you place order. Rewards points cannot be used to discount for previous orders and/or orders in process. Used Rewards Points will not be refunded if you cancel or return your order.
No payment (information) required: If you have discounted or settled full value of your order by validly applying one or more of the above mentioned options or your cart has only Product/s or Service/s we offer free; no payment information will be required at checkout page and you can proceed to the place order. When you have placed an order which does not require payment information it may take at least minimum two (02) working days to start processing your order.
Accepting of your order
Completion of online checkout procedure does not constitute our acceptance of your order. Products or Services that are offered (including Pre-order) can be those in, planning, designing, setting up, process, manufacturing, printing, reprinting and in transit, relevantly. Planning, Processing, Designing, Manufacturing and Shipping are inherently flexible and are subject to many contingencies. There is no guarantee that any anticipated startup, release, arrival or service delivery date(s) can be successfully achieved. Therefore it is mandatory for you to accept that any particular delivery date is subject to change. Additionally, some Products or Services may be limited, by quota, process or production runs or by capacity or be restricted by other unforeseen circumstances. Notwithstanding the foregoing, you acknowledge and agree that we may use Products and Services offered by us for a variety of purposes; in-house and third-party testing, evaluation, display and auctioning prior to fulfilling orders or we may decline or delay processing your order to avoid oversubscription or as it deems appropriate in other circumstances. Upon your full payment our acceptance of your order will take place when we deliver your order to a carrier and/or to you if in Cash on Delivery method.
Cancelation of Accepted order
We reserve the right cancel an order which we may have already accepted. An accepted order may be canceled in circumstances (including but not limited to) such as; Products or Services ordered becomes unavailable; Restricted by Law; the Order is considered as an unusual order or an order susceptible to fraud; there was any error in the price quoted for the order. Should an accepted order be canceled by us, we will refund only the payment made to us, less cost of if any part delivery made.
By placing an order you represent and warrant that all information you provided is accurate and that will be kept current until your order is delivered. If there is a change in the information you have already provided, you shall by quoting the Order Details (number, items, etc) promptly inform us by e-mail and update your information in your profile if relevant. However we shall not be made responsible or liable for having your information that later become outdated and we shall have no obligation to make any efforts to determine correct contact or delivery information.
Delivery to your location
You shall select a carrier listed at the Checkout page. We make our best attempt to deliver your order to the selected carrier within the stipulated date and time; however we make no warranties, expressed or implied, about the delivery dates and/or times. Based on your selecting a carrier; Parcel Post or Courier or Cash on Delivery, any additional costs incurred due to you not collecting your order promptly shall be paid by you. If you select Cash on Delivery, and you do not collect the order when the courier attempts delivery, you shall pay Rs 500/- or 10% of your order total (which ever the higher) to reimburse costs incurred for each unsuccessful delivery.
If you select to collect your order you self from a specific store, you should wait till we inform you that your order is ready for collection via email or sms or telephone. You shall ensure that the store you selected is operational on the date and time you arrive for collection. We do not guarantee that any of the listed stores will be operational at all dates and times, even if we have indicated so in our communications or websites. You shall present your order details and a proof of your identity (NIC, passport, driving license) to collect the items. You shall collect your order before 05 working days from the date the order is available for collection; if not regrettably you will be charged a cancellation fee of whichever the higher of LKR 500.00 or 10% of your order value.
International Delivery & Taxes
Your order is subject to legal, customs and such other regulations that are applicable in international delivery. Your order is priced excluding duties, taxes and other statutory payments applicable in international territory. Thus you or the recipient of your order shall be liable to pay any applicable duties, taxes and other statutory payments when your order is been delivered to an addresses outside Sri Lanka. Also you shall be fully responsible and accountable to clear all legal, customs and such other regulations if your order or part thereof is stalled, held, contained etc at any point by any regularity body.
Risk of Loss
Your order is considered delivered to you and is successfully completed, when we process and deliver your order up to the point you become responsible to receive the order. This means that the risk of loss and title for such order passes on to you upon such process.
If a Product offered by us is not as described on product page, your sole remedy is to return it to us in unused condition within seven days of delivery. A refund will be available on selected Products when they are returned in an unused and resalable condition or if the Product delivered is faulty. We do our best make the refund within ten (10) working days once the Product is received by us and subject to our approval. However you should check the package at the time delivery and ensure there are no external damages, as we do not accept any returns due to any external damages. There are no refunds for Services you have ordered, upon delivery to a Service provider.
Limitation of liability
UNDER NO CIRCUMSTANCES WE SHALL BE HELD LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OR RELATED TO THIS CONTRACT. IN THE EVENT WE ARE HELD LIABLE FOR ANY DAMAGES ARISING OUT OR RELATED TO THIS CONTRACT, YOUR SOLE AND EXCLUSIVE REMEDY WILL BE THE REFUND OF YOUR ORDER VALUE LESS COSTS INCURRED BY US.
Neither party shall be liable, for damages nor any other consequences, if the party’s obligations according to these Terms, other than the obligation to pay money, are inhibited or delayed by circumstances that the party cannot reasonably control or foresee, including but not limited to, any conflict in the workforce; natural phenomena such as lightning, earthquakes, floods etc.; fire; war; decisions and decrees made by governments or authorities; accidents; strikes or shortages of transportation facilities, fuel, energy, labor or materials; or similar circumstances.
Assignment, Waiver and Third party rights
You may not assign or sub-contract any of your rights or obligations under these Terms and Conditions of Sale to any third party. We may assign, transfer or sub-contract any of our rights or obligations under these Terms and Conditions of Sale to any third party at our sole discretion at any time without any prior notice to you. No relaxation or delay by us in exercising any right or remedy under these Terms and Conditions of Sale shall operate as waiver of that right or remedy or shall affect our ability to subsequently exercise that right or remedy. Any waiver must be agreed by us in writing.
